Official Rules

BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT. THESE OFFICIAL RULES EQUIRE YOU TO AGREE TO ARBITRATE DISPUTES RATHER THAN GOING TO COURT, GRANT US CERTAIN RIGHTS AND LICENSES, PROVIDE US CERTAIN INDEMNITIES, WAIVE CERTAIN OF YOUR RIGHTS AND REMEDIES, AND LIMIT OUR LIABILITY AND OBLIGATIONS TO YOU.

DATES OF CONTEST: Entries to the “Win a New York Getaway with Jamie Kay Contest” (the “Contest”) must be submitted between at 10:00 am New Zealand Time (“NZT”) on 25th November 2024 and 10am NZT on 3rd December 2024 (the “Contest Period”).  Sponsor’s computer shall be the official imekeeping device for the Contest.

SPONSOR:  Jamie Kay Limited, 148 Victoria St, Christchurch Central, Christchurch 8013, New Zealand

ELIGIBILITY: The Contest is open only to customers who as of the time of entry are eighteen (18) years
of age or older. Contest is subject to all federal, state and local laws and regulations. The Contest is void wherever restricted or prohibited by law.

TO ENTER: During the Entry Period, visit https://jamiekay.co.nz/pages/win-a-new-york-getaway-with-jamie-kay and follow all instructions provided, complete the form to register, and select the three items that you have chosen as your Outfit, and submit the form (your “Entry”).  Once an Entry has been submitted, it may not be changed, altered or modified. One Entry per person.

You may receive additional bonus entries for a completed, compliant order from Sponsor’s website during the Contest Period.  The bonus entries, each an Entry, must consist of a fully paid outfit order (“Outfit”) on Sponsor’s website consisting of at least 3 items.

Sponsor is not responsible for any Entry that is lost, late, misdirected or undeliverable, whether due to your account settings, system errors, omissions, interruption, deletions, defects, delay in
operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.  All Entries submitted (but not the items comprised in any order) shall become the exclusive property of Sponsor and will not be returned. Any attempt by an entrant to obtain more than the stated
number of Entries allowed by using multiple/different identities, and/or any other methods will void that entrant’s Entries and that entrant may be disqualified from the Contest.

As a condition of entering the Contest, you consent to (i) Sponsor obtaining and delivering your name, address and other information to third parties for the purpose of administering the Contest and complying with applicable laws, rules and regulations, (ii) the collection, storage and use of your personally identifiable information by Sponsor in accordance with its privacy policy, located at https://jamiekay.co.nz/pages/privacy-policy, and as otherwise set forth herein, and (iii) the publication of your full name and information, including your Entry. 
Any communication or information transmitted to Sponsor by electronic mail or otherwise is and will be treated as non-confidential and nonproprietary.

JUDGING AND WINNER SELECTION:  Eligible Entries will be judged by a qualified judge or panel of judges who will evaluate each Entry based on the following judging criteria:

1. Cohesiveness and styling of the Outfit items (80%)

2. Originality of the Outfit (20%)

In the event of a tie between more than one Entry, preference will be given to the first of those Entries which was submitted.

The winner (“Winner”) will be
determined as follows: One (1) winner will be selected by the judges within a reasonable time after the end of the Contest Period from among all eligible Entries received during the Contest Period. The judging will be conducted by Sponsor, whose decisions are final, binding and conclusive on all matters relating to the Contest. Sponsor will attempt to notify each potential winner via email within three (3) business days after selection.  If, despite reasonable efforts, a potential winner does not respond within five (5) days of the first notification attempt, or if the prize notification
is returned as unclaimed or undeliverable to such potential winner, or if such potential winner has rescinded their commitment to contract with Sponsor or its independent network prior to notification, such potential winner will forfeit the prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected, at Sponsor’s discretion.

PRIZE/PRIZE CONDITIONS: Winner will receive economy class airfare for up to two (2) adults and up to two (2) children (aged 0 to 12 years old at the time of Entry) from their nearest international airport to New York City, 4 x nights accommodation in New York from approximately 6th Feb 2024 to 10th Feb 2024, NZD$1,000 spending money, and a 60min Family Photo Shoot (including images) with the Jamie Kay Creative team (collectively, the “Prize”).  Approximate retail value (ARV) of the Prize: NZD$10,000.  Any Prize details not specified above will be determined by Sponsor, in its sole discretion.  Each Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. No Prize substitution or cash redemption of Prizes. Sponsor reserves the right to substitute any Prize with a prize of comparable or greater value if Prize should become unavailable for any reason. Prize is not transferable. Each Winner is responsible for all federal, state and local taxes arising from receipt, possession, acceptance or use of any Prize, if applicable. Limit of one (1) Prize per person. There is one (1) Prize to be won only.

Each Winner must possess all required travel documents, and comply with any applicable check-in requirements, such as presentation of a valid ID and a major credit card.  The restrictions and conditions stated herein are not all-inclusive and the Prize may be subject to additional restrictions and conditions, which may be stated in the Prize Claim Documents and/or other travel documents. Airline and accommodations are at Sponsor’s discretion.

Receiving a Prize is contingent upon
compliance with these Official Rules. Each potential winner will be required to execute certain documents, which may include, without limitation, an affidavit of eligibility, liability release, applicable tax documents, and, where imposing such condition is permitted, a publicity release (collectively, “Prize Claim Documents”). If a potential winner cannot be contacted, does not wish to accept the Prize, or fails to sign and return the Prize Claim Documents within the specified time period, that potential winner forfeits the Prize and an alternate winner may be selected in Sponsor’s sole discretion.

GENERAL CONDITIONS: If, for
any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering,
unauthorized intervention, fraud, technical failures, or any other causes, including but not limited to Acts of God, pandemics, epidemics, weather, fire, strike, acts of war or terrorism, government restriction, or any other condition beyond Sponsor’s control, which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest in whole or in part. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE
OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND,
SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM
ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO
ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE
PROVISIONS.

RELEASE: By participating in this Contest, entrants agree to release and hold harmless Sponsor, its
parent companies, subsidiaries, affiliates, agents, insurers, divisions, predecessors, successors, consultants, legal advisors, and suppliers, and each
of its and their respective officers, directors, managers, employees, agents, members, shareholders, and representatives (collectively, the “Released
Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt, redemption or use of any Prize.

LIMITATIONS OF LIABILITY: To the maximum extent permitted by law, the Released Parties are not responsible for:
(i) unauthorized human intervention in any part of the entry process or the Contest; (ii) electronic or human error which may occur in the administration
of the Contest or the processing of entries; (iii) any injury, damage or loss (including death) to persons or property of any kind, which may be caused,
directly or indirectly, in whole or in part, directly or indirectly from entrant's participation in the Contest or from the receipt, use or misuse of any Prize; (iv) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable Entries; or (v) technical failures of any kind, including but not limited to the
malfunctioning of any computer, mobile device, cable, network, hardware or software.

DISPUTES: Each entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any Prize awarded
shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New Zealand. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, an entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New Zealand, without
giving effect to any choice of law or conflict of law rules (whether of New Zealand or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New Zealand.
